Effective:  ·  Last updated:

This Privacy Policy explains how Farris Media & Marketing Management collects, uses, discloses, retains, and protects personal information when you use the Site, request a quote, place an order, upload materials, pay an invoice or deposit, join a mailing or text list, or otherwise communicate with us.

1.Information We Collect

Information you provide

  • Contact information, such as your name, mailing and delivery address, email address, and telephone number.
  • Order and transaction information, including products, specifications, quantities, deadlines, approvals, invoices, deposits, balances, delivery preferences, and customer-service history.
  • Customer Materials, such as photographs, videos, audio, logos, obituary or memorial information, names, dates, family details, service information, messages, and design instructions.
  • Account, form, survey, testimonial, review, marketing-preference, and correspondence information.
  • Payment information submitted through a payment processor. We may receive limited transaction details, such as payment status, date, amount, payment method type, and billing contact information; we generally do not receive or store complete payment-card numbers.

Information collected automatically

  • When you use the Site, we and our providers may collect device and usage information, such as IP address, browser and device type, operating system, pages viewed, links clicked, referring pages, approximate location derived from IP address, timestamps, cookie identifiers, and diagnostic or security information. Cookies and similar technologies may be used to operate the Site, remember preferences, understand traffic, prevent fraud, and—if enabled and permitted—measure marketing.

Information from other sources

  • We may receive information from a funeral home, family representative, organization, referral source, payment processor, shipping carrier, social platform, or other person involved in an order. If you provide information about another person, you represent that you are authorized to do so and to permit our use of it for the requested service.

2.How We Use Information

  • Respond to inquiries, prepare quotes, verify specifications, and communicate about orders.
  • Create, revise, proof, print, fulfill, ship, deliver, archive, and support products and services.
  • Process deposits and payments, maintain transaction records, prevent fraud, and resolve disputes.
  • Operate, secure, troubleshoot, personalize, analyze, and improve the Site and our services.
  • Send transactional messages, including proof, payment, deadline, pickup, delivery, and service communications.
  • Send promotional email or text messages when you have chosen to receive them, and manage opt-outs.
  • Comply with law, enforce agreements, protect rights and safety, and respond to lawful requests.
  • Use de-identified or aggregated information for business analysis where permitted by law.

3.How We Disclose Information

We may disclose personal information only as reasonably necessary for the purposes above, including to:

  • Vendors and service providers that support website hosting, forms, cloud storage, design and production, printing, payments, accounting, analytics, email, text messaging, customer service, shipping, delivery, fraud prevention, and information security.
  • Contractors, printers, funeral homes, organizations, family representatives, or fulfillment partners involved in completing the requested order, subject to appropriate confidentiality expectations where applicable.
  • Professional advisers, insurers, auditors, financial institutions, and legal representatives.
  • Government authorities or other parties when required by law or reasonably necessary to protect rights, safety, property, prevent fraud, enforce agreements, or respond to legal process.
  • A buyer, successor, or adviser in connection with a merger, financing, sale, reorganization, or transfer of all or part of the business, subject to applicable law.
  • Other parties at your direction or with your consent.

4.Memorial and Uploaded Content

Memorial orders may include sensitive family photographs and personal details. Upload only what is reasonably necessary for your order, and use our designated upload method. Do not send highly sensitive identifiers or records unless we specifically request them through an approved secure process. Customer Materials may be accessible to employees, contractors, and production partners who need them to perform the requested service. Public portfolio or promotional use will occur only as described in the Terms of Use and the authorization applicable to your order.

5.Email and Text Communications

Order-related messages are transactional and may be necessary to complete your request. Promotional messages are optional. You may unsubscribe from marketing email using the link in the message or by contacting us. You may opt out of promotional text messages by replying STOP or using another reasonable method stated in the message. We may send one nonmarketing confirmation of a text opt-out. Consent to promotional messages is not a condition of purchase. Message and data rates may apply. Opting out of marketing does not prevent necessary communications about an active order, payment, proof, delivery, or customer-service request.

6.Cookies and Analytics

You may control nonessential cookies through the Site's "Your Privacy Choices" or "Cookie Settings" control and may also use your browser settings. The Site will allow visitors to opt out of applicable nonessential analytics, advertising, and targeted-advertising technologies. Essential cookies needed for security, checkout, payment, uploads, fraud prevention, or core Site operation may not be disabled through the consent tool. Blocking certain cookies may affect Site functionality.

7.Retention

We retain personal information for as long as reasonably necessary to fulfill orders, maintain business and tax records, preserve proof and approval history, provide support or reorders, enforce agreements, resolve disputes, protect the business, and comply with law. Retention periods vary by information type and legal or operational need. We may delete or de-identify information when it is no longer needed. Customers should keep their own copies of final files and materials; we do not guarantee indefinite storage or future availability of working or final files.

8.Security

We use reasonable administrative, technical, and physical safeguards appropriate to the nature of the information. No website, email, text, upload, storage, or transmission system is completely secure, and we cannot guarantee absolute security. You are responsible for using secure devices and accurate contact information and for promptly notifying us of suspected unauthorized activity involving your order.

9.Your Privacy Choices and Rights

You may request access to, correction of, or deletion of personal information we maintain about you, or ask to withdraw marketing consent, by contacting [email protected]. We may need to verify your identity and authority before acting. We may deny or limit a request where permitted by law, including when information must be retained for an active order, legal obligation, fraud prevention, recordkeeping, dispute, or the rights of another person.

Depending on where you live and whether an applicable privacy law covers our business and the information at issue, you may have additional rights, such as confirming processing, obtaining a copy, correcting inaccuracies, deleting certain information, opting out of targeted advertising or certain data sales, and appealing a denied request. We will not unlawfully discriminate against you for exercising an applicable privacy right. To appeal a decision, reply to our response with "Privacy Appeal" in the subject line and explain your concern.

10.Children's Privacy

The Site is intended for adults and is not directed to children under 13. We do not knowingly collect personal information directly from a child under 13 without legally sufficient authorization. Adults submitting photographs or information about minors for a family, memorial, school, church, or organizational project are responsible for having appropriate authority and consent. If you believe a child has submitted personal information directly without authorization, contact us.

11.Third-Party Sites and Services

The Site may link to or integrate third-party services, including payment, shipping, social-media, scheduling, form, video, and communication providers. Their privacy practices are governed by their own notices. We encourage you to review them before providing information.

12.Changes and Contact

We may update this Privacy Policy as our practices, vendors, services, or legal obligations change. We will post the revised policy and update the date above. Material changes may receive additional notice when required. Questions or privacy requests may be sent to Farris Media & Marketing Management, Attn: Privacy, at [email protected], (901) 921-0110, or 2960 Chelsea Avenue Unit B, Memphis, TN 38108.
